These Terms and Conditions (“Agreement”) set forth the terms and conditions governing the use of the Boelry.com website (“Site”) operating under the Boelry brand and the purchase of products and services offered through the Site.
Anyone who visits, uses, or places an order through the Site (“User” or “Customer”) is deemed to have read, understood, and accepted the terms of this Agreement.

CHAPTER 2: Products, Pricing, and Order Process
9. Product Information
Boelry aims to present the descriptions and images of the products it offers for sale on the Site as accurately and up-to-date as possible. However, due to screen settings, differences in photography, and technical reasons, there may be slight differences between the actual appearance of the products and the images on the Site.
Such differences do not imply that the product is defective.
10. Pricing
All prices on the Site are in US Dollars (USD) unless otherwise stated. They may automatically change based on the currency of the country you are accessing the Site from.
Boelry reserves the right to change prices and promotions without prior notice. Changes are effective as of the time they are published and do not affect orders placed previously.

If an order is canceled, the amount charged will be refunded to the customer as soon as possible.
12. Order Placement
When placing an order through the Site, the user is obligated to provide accurate, complete, and up-to-date information. Boelry is not responsible for any delays or delivery issues that may arise due to incorrect or incomplete information.
Upon completion of the order, an automatic order confirmation email is sent to the user. This email indicates that the order has been received; it does not mean that the order has been definitively accepted.
13. Order Acceptance and Cancellation
Boelry reserves the right to refuse or cancel an order for any reason, including but not limited to the following circumstances:
Insufficient stock,
Failure to obtain payment authorization,
Errors in pricing or product information,
Suspicious or unverifiable transactions.
If an order is canceled, the amount collected will be refunded to the customer.
14. Stock Status and Partial Shipment
Boelry reserves the right to partially ship or cancel an order if the ordered products are out of stock. In such a case, the customer will be notified and a refund will be issued for the products not shipped.
15. Campaigns and Discounts
Campaigns, discounts, and promotions offered by Boelry may be subject to specific terms and conditions. Campaign terms are specified on the relevant campaign page.
Boelry reserves the right to change or terminate campaigns without prior notice.
CHAPTER 3: Payment Methods and Financial Terms
16. Payment Methods
Boelry may offer various payment methods through the Site. Accepted payment methods are displayed to the user during the payment process.

17. Third-Party Payment Providers
Payments are processed through secure third-party payment service providers. Boelry is not responsible for any disruptions caused by these providers’ systems or financial institutions, such as:

Blocking or chargeback transactions

18. Payment Approval and Order Processing
Boelry’s obligation to ship products and provide services is contingent upon the payment being approved by the relevant financial institution and the amount being successfully transferred to Boelry’s account.
Until payment is finalized, Boelry reserves the right to:
Suspend shipment,
Hold the order, or
Cancel the order.
19. Refunds
Refunds for any reason will be processed using the method used for payment and in accordance with the rules of the relevant payment provider.
The refund period may vary depending on the bank, card issuer, or payment provider. Boelry is not responsible for these delays.
20. Taxes
Product prices may include applicable taxes or may be calculated and collected during payment based on the delivery address.
Within the US, sales tax is automatically collected for states with legal obligations.
Boelry does not collect sales tax on shipments outside the US; however, any customs duties, VAT, or other fees that may be applied by the recipient country are the customer’s responsibility.
21. Fraudulent or Unauthorized Transactions
Boelry reserves the right to investigate, suspend, or cancel transactions suspected of being fraudulent, unauthorized, or suspicious. Information may be shared with relevant authorities when necessary.
CHAPTER 4: Shipping and Delivery
22. General Shipping and Delivery Principles
The shipment of products purchased from Boelry begins after the order and payment have been confirmed.

23. Delivery Times
The delivery times indicated on the Site are estimates and may vary due to public holidays, high demand, customs procedures, weather conditions, and reasons attributable to carriers.
Boelry cannot be held responsible for such delays.
24. Delivery Address and Responsibility
The Customer is responsible for entering the delivery address completely and correctly when placing the order. Boelry is not responsible for any delays, losses, or additional costs that may arise due to incorrect or incomplete addresses.
25. Inspection Upon Delivery
The customer must inspect the package upon delivery; in case of damage, crushing, or opening, they must have the delivery agent prepare a report and accept the package with such a report.
Otherwise, claims regarding transportation-related damage may not be accepted.
26. Undeliverable Shipments
For shipments returned to Boelry due to an incorrect address, the recipient not being present at the address, or refusal of delivery, the costs of resending the shipment may be borne by the customer.
27. Transfer of Risk
The risk of damage or loss to the products upon delivery of the products to the carrier or to the customer, as applicable under law. However, Boelry aims to provide support in cases deemed necessary within the scope of customer satisfaction.
CHAPTER 5: Returns and Exchanges
28. General Return and Exchange Principles
You may request a return or exchange for products purchased from Boelry within 30 days of the delivery date.

This Agreement applies in conjunction with the aforementioned policy.
29. Return Conditions
Unless otherwise specified in the Return and Exchange Policy,
Products must be unused,
In their original packaging and with all accessories,
In resalable condition.
Returns of products that do not meet these conditions may not be accepted. For comprehensive and definitive guidelines, please refer to the Returns and Exchanges Policy page.
30. Non-Returnable Products
The following products may not be eligible for return or exchange, subject to the exceptions specified in the relevant policy:
Products that are custom-made or altered,
Products that are not suitable for return due to hygiene reasons,
Discounted, promotional, or clearance items (unless otherwise stated in the policy).

31. Return Process
Return or exchange requests must be submitted to Boelry using the method specified on the relevant policy page. Returns sent without prior approval may not be accepted.
Boelry will inspect the returned products upon receipt and initiate the return or exchange process if they meet the conditions.
32. Refunds
For approved returns, the product price will be refunded using the same method used for payment. Depending on the bank and payment provider, it may take some time for the amount to appear in your account.
Shipping fees are non-refundable unless otherwise stated in the policy.
33. Defective or Faulty Products
For products that are damaged or have manufacturing defects upon delivery, Boelry must be contacted within 3 days of the delivery date. Such cases are evaluated separately under the Return and Exchange Policy.
CHAPTER 6: Warranty and Liability
34. Warranty Coverage
Products purchased from Boelry are covered by a warranty against manufacturing defects for 30 days from the date of delivery.
The warranty does not cover damage resulting from normal wear and tear, scratches, color changes, misuse, impact, chemical contact, accidents, or unauthorized interventions.
Warranty claims are reviewed by Boelry and resolved through repair, replacement, or refund if deemed appropriate.
35. Legal Consumer Rights
Nothing in this Agreement shall eliminate or restrict your consumer rights as provided by applicable law, which cannot be limited.
36. Disclaimer of Liability
Boelry makes no express or implied warranties regarding the Site and products other than those expressly stated. To the extent permitted by law, all implied warranties, including those of merchantability or fitness for a particular purpose, are hereby disclaimed.
37. Limitation of Liability
To the extent permitted by applicable law, Boelry’s total liability for any reason shall be limited to the amount paid by the customer for the relevant product.
Boelry shall not be liable for loss of profits, loss of business, loss of data, or any indirect, special, incidental, or consequential damages.
38. Liability Regarding the Website
The Site content is provided “as is.” Boelry does not guarantee that the Site will be uninterrupted, error-free, or secure.
Boelry is not liable for any damages arising from the use of the Site, to the extent permitted by law.
39. Indemnification
The User agrees to indemnify Boelry against any and all damages, claims, and expenses that Boelry may incur as a result of the User’s breach of the terms of this Agreement, unlawful use, or infringement of the rights of third parties.
CHAPTER 7: Legal Provisions
40. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America. Conflict of laws principles shall not apply.
41. Jurisdiction
The courts of the State of Wyoming shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement.
42. Force Majeure
Boelry shall not be liable for any failure or delay in performing its obligations under this Agreement due to events beyond the control of the parties, including but not limited to natural disasters, fire, flood, earthquake, war, insurrection, strike, epidemic, governmental action, or disruption of transportation or communications.
Obligations shall be suspended during the period of force majeure.
43. Suspension and Termination of the Agreement
Boelry reserves the right to temporarily or permanently suspend or terminate the user’s access to the Site in the event of a breach of the terms of this Agreement.
This shall not prevent Boelry from exercising its other legal rights.
44. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
45. Waiver
Boelry’s failure to exercise or delay in exercising any right shall not constitute a waiver of that right.
46. Assignment
The User may not assign the rights and obligations arising from this Agreement to third parties without Boelry’s prior written consent.
Boelry, however, may assign this Agreement in whole or in part.
CHAPTER 8: Final Provisions
47. Notifications
Any notifications to be made by Boelry may be published on the Site, sent via email, or made through the user account. These notifications shall be deemed valid on the date they are sent or published.
Notifications to be made by the user must be made in writing to Boelry’s contact addresses specified on the Site.
48. Electronic Communication and Records
By using the Site, the user accepts communication with Boelry in electronic form. Records kept and notifications made in electronic form constitute written evidence.
49. Integrity of the Agreement
These Terms and Conditions, together with the
Return and Refund Policy
constitute the entire agreement between the parties.
In the event of any conflict between these documents, the relevant specific policy provisions shall apply.
50. Effectiveness
These Terms and Conditions shall enter into force on the date they are published on the Site. The User’s continued use of the Site and/or placing an order shall constitute acceptance of these terms.
